1. Overview
This website is operated by Solution TFL. Throughout these Terms, “Solution TFL,” “we,” “us,” and “our” refer to Solution TFL. We operate solutiontfl.ca, an online store offering industrial, welding, safety, tools, and related products. Our store is hosted by Shopify.
These Terms of Service (“Terms”), together with the policies referenced below, govern your access to our website and your purchase and use of our products and services. By accessing our website, creating an account, requesting a quote, or placing an order, you agree to these Terms. If you do not agree, please do not use our website.
Nothing in these Terms limits any rights or remedies that cannot legally be excluded or limited under applicable consumer-protection or other laws.
2. Eligibility and Accounts
You must have the legal capacity to enter into a contract in your province or territory of residence. If you use our website or place an order on behalf of a company or other organization, you confirm that you have authority to bind that organization to these Terms.
You agree to provide accurate, current, and complete information. You are responsible for protecting your account credentials and for activity carried out through your account. Contact us promptly if you believe your account has been used without authorization.
We may suspend or close an account where reasonably necessary to protect the website, prevent fraud, comply with law, or address a violation of these Terms.
3. Product Information and Proper Use
We make reasonable efforts to display product descriptions, specifications, images, availability, and colours accurately. Images may be illustrative, and colours or appearance may vary according to your screen. Manufacturer specifications, packaging, model numbers, and product designs may change without notice.
You are responsible for verifying that a product is suitable and compatible with your intended application before ordering or using it. Product information on our website is general information and does not replace the manufacturer’s instructions, safety data sheets, professional advice, workplace procedures, training, fit testing, inspections, or regulatory requirements.
Industrial, welding, electrical, chemical, respiratory-protection, and safety products must be selected, installed, inspected, maintained, and used by qualified persons in accordance with the manufacturer’s instructions and applicable standards and laws. Never use a product contrary to its intended purpose.
We may correct product information, modify or discontinue products, or limit quantities, subject to applicable law.
4. Orders and Acceptance
Submitting an order requests the purchase of the selected products. An automated confirmation acknowledges receipt of the order. Whether and when a binding contract is formed is determined by the checkout information, our communications, and applicable law.
Before a binding contract is formed, we may refuse or limit an order for legitimate reasons, including product unavailability, supplier discontinuation, suspected fraud, payment failure, shipping restrictions, or an inability to fulfill the order. After a binding contract is formed, we will cancel or modify it only with your agreement or where permitted by applicable law. Nothing in these Terms authorizes us to cancel a binding consumer contract solely because of a pricing error or product unavailability where the law prohibits that cancellation. If an order is lawfully cancelled after payment, we will refund the amount charged for the cancelled portion.
Review your order carefully before submitting it. Cancellation may not be possible after an order has been processed, ordered from a supplier, prepared, or shipped. Special-order costs or restocking fees may apply where permitted by law and disclosed under our Return and Refund Policy.
Products may be purchased for personal, professional, or business use. You may not purchase products for unlawful export, sanctioned destinations, prohibited end uses, or fraudulent resale.
5. Special Orders and Quotes
Quotes are valid only for the period stated on the quote and are subject to product availability, supplier confirmation, taxes, shipping, and any stated conditions. A quote is not an accepted order until we confirm it and receive any required payment or deposit.
Products sourced, manufactured, modified, or ordered specifically for a customer may be non-cancellable and non-returnable. We will identify applicable special-order conditions before accepting the order whenever reasonably possible.
6. Prices, Currency, Taxes, and Payment
Unless otherwise indicated, website prices are displayed in Canadian dollars. Applicable taxes, shipping fees, handling charges, and other charges are calculated or disclosed before the order is completed.
Prices, promotions, and availability may change without notice. A promotion may have separate terms, eligibility requirements, dates, quantity limits, or exclusions. If promotional terms conflict with these Terms, the promotional terms apply to that promotion.
You authorize us and our payment providers to charge the payment method submitted for your order. You confirm that you are authorized to use that method and that the billing information provided is accurate. We may request additional verification or cancel an order where payment cannot be authorized.
Before a binding contract is formed, we may correct an obvious error and ask whether you wish to proceed at the corrected price. After a binding contract is formed, pricing errors will be handled in accordance with applicable law and will not be used to unilaterally increase the agreed price or cancel the order where prohibited.
7. Shipping, Delivery, and Pickup
Shipping destinations, options, charges, free-shipping thresholds, weight restrictions, and estimated delivery times are presented at checkout or communicated in a quote. Delivery dates are estimates unless we expressly agree otherwise in writing.
Delays may occur because of carriers, weather, supplier availability, remote destinations, labour disruptions, emergencies, or other circumstances beyond our reasonable control. We will provide available updates and comply with any mandatory rights concerning delayed or undelivered orders.
You are responsible for providing a complete and accurate delivery address and for ensuring that someone can safely receive the shipment when required. Additional costs caused by an incorrect address, refused delivery, missed delivery, or unclaimed shipment may be charged where permitted by law.
Risk of loss and legal ownership transfer in accordance with applicable law. Nothing in these Terms transfers risk to a consumer earlier than permitted by mandatory law. Inspect your shipment promptly and report damage, shortages, or incorrect items as described in our Return and Refund Policy.
8. Returns, Refunds, and Warranties
Returns, exchanges, cancellations, and refunds are governed by our Return and Refund Policy, which forms part of these Terms.
Some products are covered by a manufacturer’s warranty. Warranty eligibility, duration, exclusions, and remedies may vary by manufacturer and product. We may ask for the serial number, photographs, proof of purchase, inspection results, or other information reasonably required to process a claim.
Our policies and any manufacturer warranty are in addition to legal warranties and mandatory rights that apply under applicable law.
9. Acceptable Use
You may use our website only for lawful purposes. You must not:

We grant you a limited, revocable, non-exclusive right to access and use the website for lawful shopping, product research, and account management. You may not reproduce, republish, sell, distribute, modify, or commercially exploit our website content without prior written permission, except as permitted by law.
11. Reviews, Feedback, and Submitted Content
If you submit a review, photograph, suggestion, or other content, you confirm that you have the right to submit it and that it is accurate, lawful, and does not violate another person’s intellectual-property, privacy, or other rights.
You grant Solution TFL a non-exclusive, worldwide, royalty-free licence to host, reproduce, display, format, and use that content to operate, improve, and promote our business and services. This licence does not transfer ownership of your content to us.
We may moderate or remove submitted content that is unlawful, deceptive, abusive, irrelevant, infringing, contains personal information, or violates these Terms. We are not required to publish or respond to submitted content.
12. Third-Party Services and Links
Our website may use or link to services operated by Shopify, payment processors, carriers, manufacturers, review providers, mapping services, social networks, and other third parties. Their services and websites may be governed by separate terms and privacy policies.
We are not responsible for third-party websites or services that we do not control. A link does not necessarily mean that we endorse all content, products, or practices of the linked website.
13. Relationship With Shopify
Shopify provides the commerce platform used to operate our store, but purchases from our store are made directly from Solution TFL. Shopify is not the seller of our products and is not responsible for fulfilling your order, providing product support, or resolving a claim relating to a product sold by Solution TFL.
14. Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. Shopify also processes certain information as described in the Shopify Consumer Privacy Policy.
15. Website Availability and Errors
We aim to keep our website available and accurate, but we do not guarantee uninterrupted, secure, or error-free access. We may maintain, modify, suspend, or discontinue website functions when reasonably necessary.
Information may occasionally contain typographical errors, inaccuracies, or omissions relating to descriptions, prices, promotions, shipping charges, transit times, or availability. We may correct that information and address affected orders as described in these Terms and as permitted by law.
16. Disclaimer of Warranties
To the extent permitted by law, the website and its general informational content are provided on an “as available” basis. We do not guarantee that website content will be complete, current, uninterrupted, or suitable for every purpose.
Any disclaimer in these Terms applies only to the extent permitted by law. Nothing in these Terms excludes or restricts legal warranties, consumer guarantees, product-liability obligations, or other rights that cannot lawfully be waived.
17. Limitation of Liability
To the extent permitted by law, Solution TFL will not be liable for indirect, incidental, special, punitive, or consequential damages, including loss of profit, revenue, data, production, business opportunity, or anticipated savings, arising from use of the website or a product.
This limitation does not apply where liability cannot legally be excluded or limited, including liability arising from intentional or gross fault, bodily or moral injury where exclusion is prohibited, or mandatory consumer-protection obligations.
For business customers, to the extent permitted by law, Solution TFL’s aggregate liability arising from an order will not exceed the amount paid for the product giving rise to the claim. This sentence does not apply to consumers where prohibited by law.
18. Indemnification
To the extent permitted by law, you agree to indemnify Solution TFL against third-party claims, losses, and reasonable costs resulting from your unlawful use of the website, violation of these Terms, infringement of another person’s rights, or misuse of a product. This obligation does not apply to the extent a claim was caused by Solution TFL’s own fault or where indemnification is prohibited by law.
19. Suspension and Termination
You may stop using the website at any time. We may suspend or terminate access where reasonably necessary because of a violation of these Terms, suspected fraud, a security threat, legal requirements, or discontinuation of the website.
Termination does not affect an accepted order, payment obligation, accrued right, warranty claim, or provision that by its nature should continue, including provisions concerning intellectual property, liability, submitted content, and governing law.
20. Governing Law and Disputes
These Terms and transactions with Solution TFL are governed by the laws of Quebec and the federal laws of Canada applicable in Quebec, without limiting any mandatory protection provided by the laws of your province or territory.
Any dispute will be submitted to a court with jurisdiction under applicable law. Nothing in this section prevents a consumer from bringing a claim before a court or authority where the consumer is legally entitled to do so.
21. General Provisions
If any provision is found invalid or unenforceable, it will be limited or severed only to the extent necessary, and the remaining provisions will continue to apply.
Our failure to enforce a provision immediately is not a waiver of that provision. These Terms and the policies incorporated by reference constitute the agreement governing use of our website and online purchases, except for any separate written agreement or accepted quote that expressly applies to a transaction.
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms as part of a legitimate sale, reorganization, or transfer of our business, subject to applicable law.

We may update these Terms to reflect changes to our website, practices, or legal obligations. The revised Terms will be posted with a new “Last updated” date. Material changes will apply prospectively, and we will provide additional notice where required by law.
